Terms and Conditions

These Terms and Conditions (“Terms”) govern the access and use of the Prime Players SL mobile application (“App”) and the services provided, including the purchase of a membership that allows access to experiences offered by football clubs like the acquisition of rights linked to the Solidarity Mechanism.

1. Introduction

By registering, purchasing a membership, or using any service offered through the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must refrain from using the App.

2. Company Information

Prime Players SL is a company registered in Spain, operating under the brand name Prime Players. Through the App, Prime Players SL allows fans to purchase a membership linked to experiences and economic rights associated with football clubs.

3. Eligibility and User Account

To use the App and purchase a membership:

  • You must be at least 18 years of age.
  • You are required to create a user account by providing accurate and complete information.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • Prime Players SL reserves the right to suspend or terminate your account if any information provided is found to be false or if you violate any of these Terms.

4. Membership Purchase

When purchasing a membership through the App:

  • You acquire economic rights related to the solidarity mechanism that a football club holds over the players it has trained.
  • Depending on the number of the membership purchased, you gain access to levels that provide various experiences, including but not limited to discounts at the club's store, VIP experiences at stadiums, and complimentary merchandise.
  • Once the purchase is made, the service is delivered instantly.
  • The membership purchase is a one-time payment; no recurring payments or subscriptions are required.
  • All purchases are final, and refunds or cancellations are not permitted once a transaction has been completed, except where required by law.
  • Membership is non-transferable.

5. Right of Withdrawal

In accordance with applicable consumer protection laws, you have the right to withdraw from your membership purchase within 14 days from the date of purchase without providing any reason. However, by accepting these Terms and Conditions and proceeding with the purchase, you acknowledge that the service will be provided immediately upon purchase, and as a result, you waive your right of withdrawal once the service has been fully delivered.

6. Know Your Customer (KYC) Compliance

Before purchasing a membership, users must complete a Know Your Customer (KYC) verification process, providing identification and other requested information. This process is in compliance with anti-money laundering (AML) and counter-terrorism financing (CTF) regulations. Prime Players SL reserves the right to refuse or cancel a transaction if the KYC process is not satisfactorily completed.

7. Use of the App and Services

Users agree to use the App in accordance with these Terms and applicable laws. Users must not:

  • Use the App for any illegal or unauthorized purpose.
  • Attempt to interfere with or disrupt the operation of the App.
  • Upload or transmit viruses or malicious code.
  • Engage in activities that violate the rights of Prime Players SL or third parties, including intellectual property rights.

8. Intellectual Property

All content available on the App, including but not limited to text, graphics, logos, images, and software, is the property of Prime Players SL or its licensors and is protected by intellectual property laws. Users may not reproduce, distribute, or otherwise use any content from the App without prior written permission from Prime Players SL.

9. Limitation of Liability

Prime Players SL will not be held liable for any damages arising out of:

  • The use or inability to use the App or services.
  • Unauthorized access to or alteration of your data.
  • Any interruption or cessation of the service.
  • Third-party activities or conduct on the App.

In no event will Prime Players SL be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, data, or goodwill.

10. Privacy and Data Protection

Prime Players SL is committed to protecting user privacy and processes personal data in accordance with its Privacy Policy. By using the App, you consent to the collection, use, and sharing of your personal data as described in the Privacy Policy.

11. Changes to the Terms

Prime Players SL reserves the right to modify these Terms at any time. Any changes will be notified to users via the App or through other appropriate communication channels. Continued use of the App after changes have been made constitutes acceptance of the updated Terms.

12. Termination

Prime Players SL may terminate or suspend your access to the App and its services at any time, without prior notice, if you breach these Terms or for any other reason deemed necessary by Prime Players SL. Upon termination, you must cease all use of the App.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Spain. Any disputes arising out of or related to these Terms shall be submitted to the exclusive jurisdiction of the courts of Madrid, Spain.
